General Terms and Conditions (Guests)

1. Scope
These General Terms and Conditions ("Terms") govern the use of the online table reservation system Gedeckt, operated by Dipl. Ing. Michael Herceg, Grieskirchner Str. 7, 4600 Wels, Austria ("Gedeckt" or "we"), by guests and end customers ("Guest").
Gedeckt provides hospitality businesses ("Restaurant Partners") with a technical system through which guests can make table reservations. Gedeckt acts exclusively as a technical service provider and transmits the guest's reservation request to the respective Restaurant Partner.
A contractual relationship is established exclusively between the Guest and the Restaurant Partner. Gedeckt does not become a party to the reservation contract.
2. Subject Matter and Reservation Process
Gedeckt enables guests to request a table reservation via the booking widget on the Restaurant Partner's website or via gedeckt.app.
The submission of a reservation request by the Guest constitutes an offer to conclude a reservation contract between the Guest and the Restaurant Partner.
The reservation contract is only concluded upon express confirmation by the Restaurant Partner. An automatic confirmation of receipt does not constitute acceptance.
Upon reservation confirmation, the Guest undertakes to appear at the agreed time or to cancel the reservation in a timely manner.
The actual hospitality contract between Guest and Restaurant Partner is only concluded through the ordering of food and beverages on site.
3. Registration and User Data
To make a reservation, you must provide your name, a valid email address and a telephone number. This information must be truthful and complete.
The use of the reservation system is reserved for natural persons of legal age with full legal capacity. For legal entities, the reservation must be made by an authorized natural person.
The Guest is responsible for the accuracy and currency of their information.
4. Cancellation
Cancellations are possible via the cancellation link included in the confirmation email or directly with the Restaurant Partner.
The deadlines set by the respective Restaurant Partner, which are communicated during the booking process, apply for the timeliness of a cancellation.
Unless otherwise specified by the Restaurant Partner, a cancellation up to 24 hours before the reservation time is considered timely.
5. Gedeckt's Liability
Gedeckt is not liable for the fulfillment of the reservation contract concluded between Guest and Restaurant Partner. In particular, Gedeckt assumes no liability for the actual availability of tables, the quality of service, or the Restaurant Partner's compliance with reservation conditions.
Gedeckt is only liable for damages caused by intentional or grossly negligent conduct by Gedeckt. Liability for slight negligence is excluded to the extent permitted by law.
Gedeckt assumes no liability for temporary technical failures or interruptions of the system, unless these are attributable to grossly negligent conduct.
6. Data Protection
The respective Restaurant Partner is the data controller within the meaning of Art. 4(7) GDPR for the processing of guest data in connection with the reservation. Gedeckt processes the data as a processor pursuant to Art. 28 GDPR on behalf of the Restaurant Partner.
Gedeckt processes the Guest's personal data exclusively for the technical processing of the reservation and to the extent required. Data is not passed on to third parties outside the reservation process unless there is a legal obligation to do so.

7. Changes to Terms
Gedeckt reserves the right to change these Terms with effect for the future, in particular in the event of changes to the legal framework, technical developments of the system, or expansions of the service offering.
Changes will be brought to the Guest's attention during the next booking process. Continued use constitutes acceptance.
8. Applicable Law and Jurisdiction
Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers within the meaning of the Austrian Consumer Protection Act (KSchG), the general jurisdiction of the consumer shall apply. Otherwise, Wels shall be the place of jurisdiction for all disputes arising from or in connection with these Terms.
Gedeckt is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
9. Severability Clause
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
